1. TERMS AND CONDITIONS
Your use of the Anigma.com website (referred to as the “Site” below), and our services (including phone orders, online purchases, and inquiries from Anigma) are governed by the policies, terms, and conditions presented in the provided Terms and Conditions listed below. Please read the following information carefully and check back regularly for any changes/updates to the content provided. Anigma Computers maintains the website https://www.anigma.com/.
By utilizing this site or submitting an order for products or services, you designate the acceptance of, and compliance to be bound by, the Terms and Conditions set forth below individually or as an advocate for any business entity you represent.
The term “Customer” refers to any individual or business entity you are ordering goods or services on behalf of. If you do not agree to these Terms and Conditions, please do not use this site and please do not submit any orders for products or services.
2. GENERAL TERMS AND CONDITIONS
1. Customer agrees that Anigma is not responsible or legally liable for mismatched product pictures or misrepresentation in product information. Anigma reserves the right to change their products/services and specifications. Products/services are regularly updated, and those listed on the Site may not be current. Customer agrees to confirm the specifications of each product with their individual order. Anigma is only responsible for products named on the order invoice.
2. Our sales representatives are not authorized to perform any services, representations, or guarantees related to any product or service that exceed these Terms and Conditions and/or the respective product warranty. Any additional provisions or changes to your purchase must be made in writing and signed by an officer of Anigma.
3. Customer agrees that each product in a multi-item purchase from Anigma will be treated individually unless otherwise stated in the memo section of their order. Subsequently, defect, replacement and cancellation of any one item does not constitute the voiding of the entire purchase. Each purchased item will be considered individually for warranty or refund purposes unless the customer was informed otherwise in their initial invoice.
4. Customer acknowledges that shipping costs and expenses will not be subject to refund once Anigma has processed and shipped their items.
5. Customer is obligated to look over their email confirmation to ensure all shipping, billing, and items purchased are accurate. If you do not receive an email confirmation, or if your email contains inaccurate information, call us to confirm that your order went through. Do not submit multiple orders or you will be held liable for full restocking and any shipping fees your duplicate order may incur.
6. Material fees for boxes, packaging materials, and transportation are included in the shipping fees. Customer shall not be liable for additional shipping charges for purchases Anigma ships in multiple packages unless the Customer requests and agrees to shipping upgrades and upgrade shipping fees. Anigma includes shipping insurance with every order.
7. "Customer" agrees that Anigma will not be liable for delays caused by the shipping agent, to include natural disasters and inclement weather, etc.
8. Customer is responsible for maintaining the confidentiality of his account.
A. WEB ORDERING AND ONLINE SECURITY
Protecting your personal information is a priority for Anigma. We have taken every measure to ensure that your information is safe and secure so that you can rest assured when you make an online purchase from Anigma.com.
We use highly encrypted Secure Sockets Layer (SSL) technology to protect the security of your online ordering, personal, and financial information. Furthermore, we never sell or share your information with any third parties. Please note that some versions of browsers and firewalls restrict access to a secure server. In these cases, you won't be able to connect to our secure server and therefore won't be able to place an online order. If you can't access the secure server for any reason, please contact us to place an order at 1-234-678-5679. A customer service representative will be on standby to assist you in placing your order.
All trademarks and registered trademarks presented on the Anigma website are the sole trademarks of their corresponding owners and are not meant to imply any endorsement or affiliation between Anigma and these respective companies.
C. PLACING AN ORDER
If you wish to purchase Anigma products or services, you will be required to supply accurate information, including (but not limited to) personal information, credit card, and all other payment information. You agree that all the information you provide to Anigma will be correct, complete and current. You agree that you have permission to use the financial accounts used to complete your purchases. Customer will also be accountable for paying all shipping and handling charges, and taxes relating to purchases.
D. DELIVERY POLICY
Anigma ship within UAE and Internationally. Depending on the circumstances, we also accommodate Customers who need to have an item shipped to an APO/FPO address or PO Box. For more information on shipping to an APO/FPO address or PO Box, please contact an Anigma customer support representative at firstname.lastname@example.org.
All our products are securely packaged in Anigma premises and then handed over to our shipping/courier partners. Parcel tracking numbers will be sent to you via SMS or email. Please allow 3-5 working days for accessories/straight PC builds, and 10-15 working days for liquid cooling builds.
We reserve the right to charge for any address change that occurs once an order has been processed and shipped. Due to the abundance of wrong addresses submitted by customers, we now reserve the right to charge the exact fees that the shipper/courier charges us to reroute your package if you fail to enter the shipping address correctly. When placing an order, you acknowledge this term and authorize Anigma to charge your credit card for these shipping fees.
E. SHIPPING DELAYS
Once an order has shipped, it is up to the shipping courier to deliver the products. Anigma will not be able to prevent the shipment from being delivered once it has shipped. If the shipper/courier loses the package, it is their sole responsibility to locate the shipment.
In the event of a lost shipment, Anigma will not replace packages until the shipper/courier confirms that the package is indeed lost and that it will not be delivered to its destination. This policy helps to avoid double shipment and additional restocking fees for customers.
Generally, every package we ship requires a signature upon receipt. Please note that if there is no one to sign for the package upon delivery this may result in a delay in delivery. In the event that a package is returned to Anigma due to lack of delivery signature or if the address was entered incorrectly at the time you placed the order, you will be charged to ship the order out a second time.
F. PRICING AND TYPOGRAPHICAL ERRORS
Due to the fast pace and ever-evolving climate of the computer industry, all Anigma prices are subject to change without notice. We strive to list the most accurate, up to date pricing, specifications, and product information. Despite our attempts, some items on our website may be mispriced due to recent changes in pricing. If any Anigma stock is listed at an incorrect price due to a typographical, photographic, or technical error or due to an error in pricing from our vendors, Anigma maintains the right to refuse service or cancel any orders placed for any product listed at an incorrect price. Always check your invoice for the most accurate pricing before completing your order.
In the event that your credit card has been charged for the incorrect price, we will immediately refund your payment and cancel your order. You may repurchase it for the correct price at any time. Due to the buoyancy in pricing for computer products and the nature of our customized products/services, we don't match competitor's pricing. We do not offer price protection. For example: If Intel drops the price of a processor seven days after your purchase, that is beyond our control, and we will not refund the difference in price.
G. ORDER ACCEPTANCE POLICY
The receipt of an electronic or phone order confirmation does not imply our approval of your order. Anigma reserves the right to accept or decline your order for any reason, any time after receipt of your order.
All software produced through the website is subject to the license agreement that is part of the package you receive from Anigma. You are bound by the license agreement once the container is opened, or if its seal is broken. The title to this software remains with the licensor of the software. Anigma does not offer warranties on any software.
I. NOT FOR RESALE
Customer agrees that they are buying Anigma products for your own use and not for resale or redistribution.
J. GOVERNING LAW
This agreement and any sales at Anigma will be governed by the laws of United Arab Emirates.
K. ANIGMA TRADEMARKS
You will not designate, use or register any Internet domain name that contains an Anigma trademark or trade name in whole, part, or by any other name that is similar.
L. DISCLAIMER AND LIMITATION OF LIABILITY AS TO PRODUCTS SOLD
YOU AGREE THAT THE SOLE AND EXCLUSIVE MAXIMUM LIABILITY TO ANIGMA ARISING FROM ANY PRODUCT SOLD BY ANIGMA SHALL BE THE PRICE OF THE PRODUCT ORDERED. IN NO EVENT SHALL ANIGMA, ITS DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, OR REPRESENTATIVES BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RELATED TO PRODUCTS SOLD. ANIGMA WILL NOT BE HELD LIABLE BEYOND THE ORIGINAL INVOICED PRICE OF THE PRODUCT ORDERED.
M. URL ADDRESS WEBSITE DISCLAIMER AND LIMITATION OF LIABILITY
THE URL ADDRESS WEBSITE AND THE MATERIALS THEREIN ARE PROVIDED “AS IS.” ANIGMA MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESSED OR IMPLIED, OF ANY KIND WITH RESPECT TO THE ANIGMA.COM SITE, THEIR OPERATION, CONTENTS, DATA, OR MATERIALS ON THE SITE. YOU AGREE THAT ANIGMA, ITS DIRECTORS, OFFICERS, EMPLOYEES OR OTHER REPRESENTATIVES SHALL NOT BE HELD LIABLE FOR DAMAGES RESULTING FROM THE OPERATION, CONTENT OR USE OF THE ANIGMA WEBSITE. YOU AGREE THAT THIS LIMITATION OF LIABILITY IS COMPREHENSIVE AND APPLIES TO ALL DAMAGES, INCLUDING BUT NOT LIMITED TO: DIRECT, INDIRECT, COMPENSATORY, SPECIAL, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES.
N. TITLE TRANSFER
Anigma maintains title to parts and complete systems purchased until the purchaser pays for items in full, at which time the title passes to the purchaser.
O. RETURNS / REFUNDS POLICY
Refunds are issued only for the sale amount at the current selling market value of the component(s) inside the computer and doesn't include shipping/freight charges. Additionally, we reserve the right to apply a 15% restocking fee to computer system unless ALL three conditions below have been met:
1. Your UNOPENED purchase is returned to Anigma within 30 days of original delivery.
2. There is defective hardware component(s) inside the computer creating stability/performance issue.
3. Anigma or a third-party computer company contracted by Anigma has verified that the stability/performance issues are a direct result of the hardware inside the computer and NOT the software (i.e. the operating system, drivers, or software)
Any and all merchandise returned to Anigma must be returned in its original packaging, to include manuals and all accessories. All sales on software items are final. Opened accessories such as the speakers and monitors can not be returned and will not be extended a refund in any way, shape or form. Anigma will not refund shipping costs, and the Customer will be held liable for shipping fees associated with returning packages.
Please note that all original sales receipts are required for all returns. The Anigma 30 day money back guarantee is only honored if the computer system is returned to Anigma within 30 days from the date of purchase and the computer system MUST have defective hardware. The customer is liable and responsible for all return shipping fees. Refund prices will be for the full purchase price of a new Anigma computer at current market price. (Please review Section F).
If happens that Anigma sent an incorrect item, defective (manufacturers fault), or was damage during shipment, it will be either replaced, subject to availability or received a full refund. Shipping fees incurred in returning to customer will cover by Anigma.
Before making any return, be sure to backup all software and data and remove any personal information, private information or private content that you do not want to be viewed or used by any third party. Anigma is not liable for lost data or misuse of data on computers that are returned for any reason.
P. WARRANTY SERVICES
Anigma will cover shipping costs and will replace the part(s) for the first 30 days after receiving your order. After 30 days, Anigma will honor warranty services and replacements with the exception of shipping costs. At this point, the Customer will be liable for all shipping costs. Furthermore, Anigma reserves the right to use similar products for all repairs to computer systems if the original product is out of stock.
Q. REFUSED SHIPMENTS
Any product that Anigma ships out to Customer that comes back to Anigma as refused delivery will subject to fees. In the event of a refused delivery, Anigma reserves the right to apply a 15% restocking fee. Additionally, the Customer is responsible for any and all original and return shipping fees associated with their purchase.
R. REFUNDS AT MARKET CURRENT MARKET VALUE
Since every computer system is customized to exact specifications, it becomes near impossible to return computer systems for a full refund. If you receive a computer with defective hardware, we will be happy to extend a full refund (minus shipping costs). This protects the Customer and Anigma from price adjustments due to manufacturers that are out of both Anigma's and the Customer’s control. All approved refunds will be made onto the original mode of payment and will be processed within 10 to 45 days depends on the issuing bank of the credit card.
S. CHANGES TO ANIGMA TERMS AND CONDITIONS
We reserve the right to make changes or alterations to the Anigma Terms and Conditions at any time. As such, we encourage you to check back regularly.
T. UAE VAT POLICY
The UAE Ministry of Finance has published the Federal Decree – Law No. (8) of 2017 on Value Added Tax (the VAT Law).
Effective 01 January 2018, VAT will be applicable for most of the goods and services supplied in the UAE by any person or business at a standard rate of 5% except where the supply is specifically zero-rated or exempted under the VAT Law.
Anigma Computers is required by law to collect 5% VAT on orders shipped within the UAE & KSA. However, the total price of your order will be confirmed at checkout.
U. CANCELLATION POLICY
If you would like to cancel an order after purchasing it, you can contact us directly at 971 2 5845695 10:00am to 10:00pm (UAE time). Please note that Orders cannot be canceled over email or by leaving voice mails.
You can confirm order cancellation by checking the order status online. Orders processed by credit card may be subject to a cancellation processing fee (up to 9%).
Cancellation of order will be allowed only within 24hours from purchased for computer pheriperals and if PC order has been built in our facility but has not yet shipped, there will be an additional 15% restocking fee to cover expenses for disassembling the system and re-stocking the hardware.
